King's Library Hosting provides internet
World Wide Web page hosting and DNS hosting services. King's Library
Hosting has certain legal and ethical responsibilities regarding the
use of its computer network and equipment involved in these
services.
King's Library Hosting general policy is to act as a neutral
provider of access to the global Internet. King's Library Hosting
reserves the right to suspend or cancel a customer's access to any
or all services provided by King's Library Hosting when King's
Library Hosting decides that the account has been used
inappropriately.
King's Library Hosting does
not actively monitor nor does King's Library Hosting exercise
editorial control over the content of any website, electronic mail
transmission, mailing list, or other material created or accessible
over King's Library Hosting's services. However, King's
Library Hosting reserves the right to remove any materials King's
Library Hosting does become aware of that are, in King's Library
Hosting's sole discretion, potentially illegal, could subject King's
Library Hosting to liability, deemed erotic and/or porno or violate
this policy.
Use of Our Servers
Web site accounts are to be used by the primary owner only.
Customers are not permitted to resell, store, or give away web
hosting services off of their web site to other parties. Web hosting
services are defined as allowing a separate, third party to host
content on the owner's web site. Exceptions to this include ad
banners, classified ads, personal ads, and reseller accounts.
Unauthorized Use of Other People's Accounts or Computers
King's Library Hosting will strongly react to any use or
attempted use of an internet account or computer without the owner's
authorization. Such attempts include tricking other people into
releasing their passwords, password cracking, security hole scanning
etc... Any unauthorized use of accounts or computers by a King's
Library Hosting customer, whether or not the attacked account or
computer belongs to King's Library Hosting, will result in action
against the attacker. Possible actions include warnings, account
suspension or cancellation, and civil or criminal legal action,
according to the seriousness of the attack.
Commercial Advertisements with E-mail - Spamming
Unsolicited commercial advertisements are not allowed in e-mail,
and will result in account suspension or cancellation. Commercial
advertisements are not welcome in most Usenet discussion groups and
by most email users. Inappropriate postings may result in account
suspension or cancellation. Spamming, or sending a message to many
different off-topic newsgroups, is unethical and will be treated as
such. The use of King's Library Hosting's email servers to
distribute spam emails is strictly prohibited and will not be
tolerated. Any user causing King's Library Hosting's network, in
whole or in part, to be listed on any blacklists and/or ban lists
shall have their account terminated without notice. King's Library
Hosting will also not tolerate any website on the King's Library
Hosting network to be advertised in the form of spam for any reason.
This includes spam that is not sent via King's Library Hosting's
mail servers.
About Unlimited Disk Space and Bandwidth
King's Library Hosting does not support or tolerate unlimited
disk space and bandwidth offers. King's Library Hosting will not
allow resellers of King's Library Hosting's services to advertise
unlimited disk space or bandwidth due to the unnecessary stress put
on the service by advertising such claims. These claims are proven
to be false and will not be allowed on the King's Library Hosting
network.
Payment Policies & Billing Procedures
All accounts are set up on a pre-pay basis. All pricing is
guaranteed for the term of pre-payment. King's Library Hosting
reserves the right to change prices at any time. Payment is due each
anniversary month or period following the date the account was
established. All account payments must be made is U.S. dollars. If
10 days have passed and payment has not been posted, the account
will be suspended until further notice. The customer is responsible
for all money owed on the account from the time it was established
to the time that the customer notifies King's Library Hosting to
request termination of services. Should an account remain suspended
due to non-payment of service, the account and the content will be
deleted without notice to the customer. Suspended users must pay all
outstanding balances before the account will be reinstated. The
outstanding balance on suspended accounts can be found by logging
into the control panel. All suspended accounts are subject to a $10
account reactivation fee. This must be paid before the account will
be reactivated.
Resellers
Resellers are ultimately responsible for any and all material on
their accounts, as well as the accounts of their customers. In the
event that a resellers' customer violates any of the King's Library
Hosting terms of service or acceptable usage policy, it is at King's
Library Hosting's discretion to suspend or remove the customer's
account or the reseller's account. Our Resellers should also note
that in the event of their reseller account being suspended that all
of their customer's accounts will also be suspended, virtually
stopping all resources from being used by that reseller. Any
reseller, who is not paying the billable user account overage fee,
is not allowed to use any more then 50 user licenses at any one
time. Resellers can change their account type to an account with a
billable user account overage fee by contacting support@kingslibraryhosting.net,
or by submitting a support ticket. Resellers are also responsible
for any and all charges, including overages charges, generated to
their account by their customers. This includes, but is not limited
to IP addresses, bandwidth, and disk space. It is the reseller's job
to make sure their clients are being properly billed for these
overages.
3rd Party Scripts/Programs
King's Library Hosting provides one touch installs for many
scripts publicly available on the internet, however, we do not
support these scripts. All 3rd party scripts such as phpBB2,
OsCommerce, and CGI scripts are supported by their creators. King's
Library Hosting simply does not have the resources to support every
3rd party script on the internet. This includes, but is not limited
to, technical support, installations, and upgrades of these 3rd
party scripts. King's Library Hosting is happy to look at any 3rd
party script for a customer to determine if there would be problems
installing the script on King's Library Hosting servers, however,
King's Library Hosting will not install the script or customize the
script for you due to resource restrictions as well as liability
issues.
Data Backups
King's Library Hosting is conscious of the fact that accidents
happen and hardware does fail. For these reasons, King's Library
Hosting performs daily backups of all customers' data. These backups
enable King's Library Hosting to recover customer's data in the
event of a hardware failure or other disaster. Even though King's
Library Hosting provides daily backups of all customers' data,
King's Library Hosting still recommends that each customer make a
separate backup of their data on their own machine. King's Library
Hosting will not be held responsible for data loss due to customer
negligence in terms of failure to back up their own data.
Account Cancellation
King's Library Hosting reserves the right to cancel a customer's
service at any time. If cancellation is caused by the customer's
violation of these policies, no refund is due. Customers may cancel
service at any time, however no refund is due. Due to security
reasons King's Library Hosting customers may only cancel their
account by logging into the control panel and filing a Trouble
Ticket. Then, a representative will contact the account holder using
the account holders telephone number in order to verify the request
to cancel service. Cancellation emails sent to any King's
Library Hosting email address will not be considered valid until the
return telephone contact has been made. Cancellations via phone will
also not be accepted. This procedure allows us to fully
verify all account cancellation requests.
30 Day Money Back Guarantee
King's Library Hosting does offer a 30 day money back guarantee
to its shared hosting and reseller customers. This money back
guarantee is honored under any circumstances, unless the account was
cancelled or terminated by King's Library Hosting staff OR the
account has used more then 75% of the resources assigned to the
account. Under those conditions, the 30 day money back guarantee
becomes null and void. The 30 day money back guarantee is a no
questions asked guarantee. To exercise your right to this guarantee,
please click "Money Back" in the control panel. The money back
guarantee is not available for dedicated server customers.
Lawful Purpose
King's Library Hosting reserves the right to refuse service to
anyone. Customers may only use King's Library Hosting servers for
lawful purposes. Transmission of any material in violation of any
federal, state or local regulation is prohibited. This includes, but
is not limited to copyrighted material, material legally judged to
be threatening or obscene, and material protected by trade secrets.
King's Library Hosting expressly forbids anyone from using King's
Library Hosting servers for the propagation, distribution, housing,
processing, storing, or otherwise handling in any way lewd, obscene,
or illegal materials. The designation of any materials as such
described above is left entirely to the discretion of the King's
Library Hosting management.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold
King's Library Hosting harmless from any and all demands,
liabilities, losses, costs and claims, including reasonable
attorney's fees asserted against King's Library Hosting, its agents,
its customers, officers and employees, that may arise or result from
any service provided or performed or agreed to be performed or any
product sold by customer, its agents, employees or assigns. Customer
agrees to defend, indemnify and hold harmless King's Library Hosting
against liabilities arising out of; (1) any injury to person or
property caused by any products sold or otherwise distributed in
connection with King's Library Hosting's servers; (2) any material
supplied by customer infringing or allegedly infringing on the
proprietary rights of a third party; (3) copyright infringement and
(4) any defective products sold to customer from King's Library
Hosting's servers.
Disclaimer
King's Library Hosting will not be responsible for any damages
your business may suffer. King's Library Hosting makes no warranties
of any kind, expressed or implied for services we provide. King's
Library Hosting disclaims any warranty or merchantability or fitness
for a particular purpose. The includes loss of data resulting from
delays, hardware failure, non-deliveries, wrong delivery, and any
and all service interruptions caused by King's Library Hosting and
its employees. King's Library Hosting reserves the right to revise
its policies at any time with or without prior notice to our
customers.
